Filing A Workers’ Compensation Claim

If you have been injured in the workplace, merely reporting your injury to your immediate supervisor is not equivalent to filing a Workers' Compensation claim. There are at least a couple of things that you have to accomplish to initiate a claim. You must fill out the claim form for your employer's copy, and you must complete an application for adjudication of claim which you then file with the Workers' Compensation Appeals Board in your state.

Like any other personal injury claims, a Workers' Compensation claim comes with statute of limitations. It would be to your advantage to file your claims as soon as possible to be entitled to the benefits. Otherwise, the time limit might lapse and you will be barred forever to file your claims.

If your employer's insurance company has denied any obligations for, or does not even bother to acknowledge your illness or injury, then you have within one year from the date of your illness or injury to file a Workers' Compensation claim. In case it is for death benefit claims, the survivors of the employee who died on the job must file within one year from the date of death.

To preserve your rights under the Workers' Compensation law, you must see to it that you file a claim for any kind of work-related injury which requires more than just first aid although you may think that the injury is not serious. But if the possibility exists for future complications to develop, it is even more important to file your claim immediately. Failure to do this very important task may result in losing your right to compensation. The best time to file a claim would be no later than 30 days since you incur a work-related injury.

In case you failed to file a claim on time, it is not too late: go and seek the assistance of a competent attorney. You may still be allowed to file a Workers' Compensation claim despite the lapse of the statute of limitations.
