Slip and Fall
Slip and fall lawsuit, or business premises lawsuit, arise from falls and injuries sustained in a public place. The damages in these cases are usually the same as those in motor vehicle accidents, that is, you can sustain serious and costly injuries. The effect on you will be much greater especially if you do not have medical cover. Slip and fall cases are usually covered by commercial or property liability insurance policies.
To win the case, you, as a plaintiff, must be able to prove that the storeowner was negligent by showing a breach of the proprietor's duty to use reasonable care. You have the burden to prove that the owner had either actual or constructive notice of a foreign object on the floor or of a hazardous condition that the defendant failed to remedy. You must also show sufficient evidence that the storekeeper has failed to warn or protect customers from the danger that caused the accident.
Lawsuits of this type are increasing, leading large store and food chains to institute procedures that require employees to regularly perform safety audits and check for hazardous conditions in the premises. Some retail chains even document such audits in operating manuals.
Persons who can be named as defendants
If you were injured because you stepped on a piece of fruit or loaf of bread on the supermarket floor, you can name the following as defendants: the company or corporation operating the store, its store manager, the company's employee who has the duty to sweep the floor, and the owner of building, in case the defect was in the floor covering.
In slip and fall cases other than those that occurred inside a supermarket, possible defendants may vary but you can still use the same inclusive approach above. If you have been a victim of slip and fall accident, do not delay in enlisting the help of an attorney.
