About Personal Injury

Personal injury occurs when people are injured by the negligence of others. In present society, our laws impose on all of us the duty to exercise reasonable care in all activities which may carry the risk of inflicting injury on other people. Failure to exercise such care is a breach of this duty and, when injury or damages result, this becomes the basis for personal injury liability.

Personal injury may involve injuries or damages resulting from accidents, medical malpractice, negligence or other wrongful acts. In some states, nursing home negligence, consumer products liability, and wrongful death also constitute personal injury. It may be intentional or may occur through carelessness. Negligence, under the law, is a civil wrong or tort, and a person who suffers personal injury as a result of another person's negligence is entitled to get compensation from the wrongdoer.

Personal injury lawsuits are actions brought by plaintiffs seeking to obtain compensation for injuries and damages arising from them. Defendants in such cases typically have automobile, medical malpractice or similar types of insurance. The plaintiff usually needs the services of an attorney to help prove allegations of negligence leading to the personal injury. Because of the insurance cover, the defendant's insurance company has the duty to defend its insured customer who is being sued.

Negligence cases can be as simple as a slip and fall on a banana peel in the grocery store to airline crashes due to malfunctions. The largest number of personal injury cases, however, involves automobile accidents. The plaintiff cannot assume that automobile accident cases are easy to handle; even the simplest cases, where injuries are not serious, can still involve complicated legal issues.

Most personal injury cases which involve insurance are often settled before coming to trial. Plaintiffs thus need an attorney whose negotiation skills must be as good as, if not better than, his/her litigation skills, in order to ensure that appropriate compensation will be obtained, in fair and just proportion to the extent of personal injuries and damages suffered.
